Tau Kok and Lyeemoon. A rent of $5.00 was to
be paid annually until reclamation was effected
when an appropriate tax was to be paid.
On
a consideration of Exhibits "C", "E" and "H"
it seems clear that the concession included
land above the sea level as well as land
covered by water. Land in private ownership
and quarries were expressly excepted from the
concession which is stated to be of Government
waste land. The Court finds that the expression 600 odd mau might cover an area between
600 and 650 mau but could not exceed 650 mau
one mau being equal to .208 acres and 4.8 mau
being equal to one acre."
We may here mention that between the date of the
Agreement hereinbefore alluded to and the date of the
presentation of the Claim to the Land Court one of the Vendors
Ho Amei had died, hence the allowance of the Claim by the Land
Court in the name of Ho Lap Pun only.
At this juncture we would refer you to Sections 13,
14, 15 and 16 of the New Territories Land Court Ordinance
